Terms and Conditions of Sale

By placing an order with Cloudy Trade, WE agree to be bound by the following Terms and Conditions. Please read them carefully before proceeding with your purchase.

1. Order Acceptance and Payment

  • 1.1. Order Placement: All orders are subject to acceptance and product availability. The completion of the online checkout process does not constitute our acceptance of your order. We reserve the right to refuse or cancel any order for any reason at our sole discretion.
  • 1.2. Full Payment: As stated, full payment is required at the time of order placement to successfully secure and confirm your order. We accept [Alipay, Local Bank Transfer, Western Union, MoneyGram, PayPal, International Bank Transfer].

2. Product Information

  • 2.1. New Devices: Unless explicitly stated otherwise, all phones sold are brand new, factory-sealed, and come with the full manufacturer’s warranty and original accessories. We do not open sealed boxes to verify contents. Any warranty claim for missing items or manufacturer defects must be processed directly with the phone manufacturer.
  • 2.2. Used/Refurbished Devices: Used or refurbished phones are available only upon specific request and as a separate quotation. These devices are sold “as-is” unless a specific warranty is outlined in their separate product description.

3. Shipping and Delivery

  • 3.1. Delivery Estimate: We endeavor to process and dispatch orders promptly. The estimated delivery time for in-stock items is 3 to 14 business days worldwide, depending on the destination and selected shipping method. This is an estimate and not a guaranteed date.
  • 3.2. Shipping Costs: Shipping costs are calculated at checkout and are the responsibility of the customer unless a specific free shipping promotion is applied.
  • 3.3. Delivery Address: You are responsible for providing a complete, accurate, and deliverable shipping address. We are not liable for packages lost or delayed due to an incorrect or incomplete address provided by the customer.
  • 3.4. Import Duties and Taxes: For international orders, any import duties, taxes, or customs clearance fees are the sole responsibility of the recipient. We have no control over these charges and cannot predict what they may be.

4. Reseller Program & Bulk Discounts

  • 4.1. Eligibility: We are pleased to offer major discounts to verified resellers and businesses. To qualify for reseller pricing, orders must typically be for five (5) or more devices of the same model.
  • 4.2. Verification: We may require proof of business registration or reseller certification to grant discounted pricing. Please contact our sales team at [Sales Email Address] before placing a bulk order to receive a formal quote and confirm eligibility.

5. Returns, Refunds, and Warranty

  • 5.1. Manufacturer’s Warranty: New devices are covered by the standard international or local manufacturer’s warranty. Cloudy Trade acts as a facilitator for warranty claims but is not the warrantor. All warranty service is performed by authorized manufacturer repair centers.
  • 5.2. Return Policy: Due to the nature of sealed electronic products, we do not accept returns or offer refunds simply because you changed your mind. Returns are only accepted under the following conditions:
    • Dead on Arrival (DOA): You must notify us within 48 hours of delivery and provide video evidence of the unboxing and the faulty device. The device must be unused and in its original sealed condition (now opened).
    • Wrong Item Shipped: If we accidentally ship the incorrect model, you must notify us within 48 hours of delivery.
  • 5.3. Process: All returns must be pre-authorized by our support team. Please contact us to initiate a return request.

6. Limitation of Liability
To the fullest extent permitted by law, Cloudy Trade shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to the purchase, delivery, or use of our products.

7. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of Peoples Republic of China.
